Conflict Resolution and Mediation in Corporate, Organisational and Healthcare Disputes

I hold a Chair in Corporate and European Law, co-edit the "Vienna Commentaries" on the Austrian Commercial Code (UGB) and the Limited Liability Company Act (GmbHG), and am a mediator registered with the Austrian Federal Ministry of Justice. My teaching and research also cover medical law, in particular the legal forms of medical practice and cooperation.

That combination defines my practice. I work on disputes in which legal structure and personal breakdown are intertwined – conflicts among shareholders, between management and ownership, and in deadlocked succession or restructuring processes. These are situations in which a judgment could settle the legal questions without resolving what caused the conflict in the first place. A second focus lies in healthcare: disputes between physicians, group practices and institutional providers, friction in the cooperation of different professional groups, and the communication between clinicians, patients and their families – settings shaped by firm hierarchies, ethical questions and decisions taken under sustained pressure.

Mediations are conducted in German or English. I accept only a very limited number of cases each year, so that each receives my full attention.

Confidentiality. As a registered mediator I am bound by statutory professional secrecy under the Austrian Civil Law Mediation Act. It covers the existence of the mediation, its content and all documents entrusted to me; what is discussed cannot be used in subsequent court proceedings. For the same reason I name no clients and publish no case reports.
